PLANNING APPEAL UPDATE

RE CASTLETHORN CONSTRUCTION DEVELOPMENT ON BRIGHTON ROAD:

PERMISSION GRANTED:

Permission was granted by Dun Laoghaire Rathdown County Council (DLRCoCo) on 3r March 2014 for 104 units comprising 89 houses (two storeys high: detached, semi-detached and terraced) and 15 apartments (three storeys high: two blocks) subject to 37 conditions.

 

HISTORY:

This planning application was originally approved by DLRCoCo on 24th July 2008 for 114 residential units consisting of 33 houses (mainly 3 storeys) and 81 apartments in seven blocks (3 to 5 storeys).  However the decision was overturned on appeal by An Bord Pleanala summarised that on the basis it is considered that the proposed quantum of development represents overdevelopment of this site which would seriously detract from the established, landscape dominated character of the area.  The proposed development would, therefore, be contrary to the proper planning and sustainable development of the area’.

APPEAL TO AN BORD PLEANALA:

FACE engaged the services of Feargall Kenny, registered Architect and Planning Consultant, to submit an appeal to An Bord Pleanala on 31st March 2014 focussing on the main concerns in relation to:

  • Increased traffic and congestion in the area created by the development
  • The access point to the development located on a dangerous section of a substandard road leading to concerns about traffic hazard and road safety at this point
  • The proposed quantum of development represents an overdevelopment of this site which would seriously detract from the established, landscape dominated character of the area which is listed as an Architectural Conservation Area in the Dun Laoghaire Rathdown County Development Plan 2011-2016.

Whilst recognition is given to the serious effort made by the developer  to overcome the reasons for the decision by An Bord Pleanala to refuse permission for the previous proposal, the issues summarised above still remain and, in view of DLRCoCo’s Condition No 11 of the decision to grant planning permission requiring an independent Road Safety Audit, it is submitted that at the very least this application is premature until a satisfactory Road Safety Audit is submitted to the Planning Authority.
